PART 2 : WILL WE GET BACK OUR PAY

By Unknown - July 07, 2013

FINALLY SOMEONE IS DOING SOMETHING ABOUT THIS MATTER !
Middleman !

01 July 2013
This Middleman created an what's app group and there are 8 person inside including myself .

01 July 2013 4:34pm
Middleman reply : Hi , My name is xxxxxxx, and i am here on behalf xxxx shop to discuss about your wages !

01 July 2013 4.34pm
My reply : Hi

01 July 2013 4:35pm
Colleague A reply : Yeah are we getting our pay back already ?

01 July 2013 4;36pm
Middleman reply: Please note this is strictly without prejudice discussion and i will not answer any question that's not relevant to your wages

01 July 2013 4:36 pm
My reply: Okay sure. so when are we getting our pay which we waited for very long?

01 July 2013 4:36pm
Colleague A reply : so are we getting our pay back alr ?

01 July 2013 4:37pm
Middleman reply: And it will help if you don't ask the same question repeatedly or if someone had asked it

01 July 2013 4:40pm
Colleague B reply: Hi xxx, what solution do you suggest ?

01 July 2013 4:42pm
Middleman reply : For the record, legally speaking, the wages due to you is owed by the Retail People, which xx shop is under the care of. Despite that, Boss xx has always been willingly to work on paying back, so now before i suggest a repayment plan, i like to get an general consensus about priority. In your opinion, who should be paid first, the one who is owed the most or the ones who owed the least.

01 July 2013 4:45pm
Colleague B: Understood. Priority in terms of ?

01 July 2013 4:44pm
Middleman reply:  If its the person who is owed the most, the second person in line will be paid in a few weeks time, while if you start from the least, a few can be paid at the same time.

01 July 2013 4:45pm
Colleague B reply: Do you have an approximate date by which everyone will receive their pay?

01 July 2013 4;47pm
Middleman reply : I need an answer from each of this before we move to the next step. if i don't respond immediately, it just means i m in a meeting and will reply soon as i can. The first person can be paid this week, the final one will likely be end of the year.

01 July 2013 4:48pm
My reply : End of the year?! To be honest i think all of us have been very nice to boss xx, she say she need more time we agreed and give her some time and after a while she MIA and whatever reason i don wish to know. and now you come into the picture and expect us to wait again? You should put yourself into our shoes and understand how we feel. Btw this is my opinions , no offends

01 July 2013 4:51pm
Colleague A: Which mean your company or your or boss xxx can only raise about $800 a month to pay us back ?

01July 2013 5:06pm
Middleman reply: I have no ties to xx shop and have made myself available just for one purpose- to find resolution to this matter. I have asked a simple question and hope to receive an answer to that. i shall leave you to your separate group chat discussion and address your answer later tonight.

01 July 2013 7:25pm
Colleague C reply: Can i suggest an alternative? That xx shop pay by the month. As i am being owed my Jan pay ( because Jan cheque bounced), Boss xx previously said she will pay me earliest. Other Than that , i am willingly to wait for the Feb pay cheques at a later time of a year.

01 July 2013 7:40Pm
Colleague C reply: On further thoughts, after going by the month, if there are several people for a specific month, then xx shop should pay by urgency, meaning internally us girl will come to consensus and let you or whoever know who needs the money more urgently can get back the pay for that month first. i think this suggestion is farier to all than paying either those who gets owed most or owed least

01 July 2013 8:14pm
Middleman reply:  so which is it now, to pay the person who is owed the most or the new suggestion for consideration? I shall leave this conversation until tomorrow noon when hopefully a decision is reached.

01 July 2013 9: 11pm
Colleague C reply : Please pay Tiffany the full amount owed to her first ( $170+, i think) as she is leaving for overseas. As for the rest of us, everyone is generally agreeable to my suggestion that xx shop pays everyone by the month of Jan, then Feb then mar..Then within each mth, if xx shop is unable to pay all at one go , pls pay by whoever's salary owed is the most in descending order ( since that is the nest consensus agreed earlier in e day)

Continue 9:19pm
Colleague C reply: As for xx and her friend xx, we are unable to contact them at all since April, they could have gone back to Vietnam for their hols. so i guess they have no urgency for the salaries owed, nonetheless you might like to try contacting them individually instead

Continue 9:19pm
we hope this payment plan is satisfactory for xx shop and boss xx. As this concern money , everyone is sensitive about it and really want to get back what we r owed. following what has alr happened the past couple of mths, i think it is also only right that there can be some black and white or binding agreement xx shop or boss xx can provide to us. At least provide us with contact details of someone who will respond to us , and not just disappear.

Continue 9:21pm
Other than that i think everyone involved just wan to get their money back and put this matter behind them. Pls convey our suggested payment plan and these to boss xx. Thanks !

He talk till like as if we are in fault and he do not have any fault !

The middleman reply: This is the second and final time i will repeat my earlier statement, but will make it clearer this time round. Your wages are owed by the retail people. As some of you have found out through legal recourse, after getting the labor court judgment, your other and perhaps remaining alternative is obtain a WSS against the retail people. Notice it was never mentioned the individuals who own the company but the retail people as the defendant?  In this particular matter, such individuals will not be made financially liable for those debts. Boss xx has taken up moral, not legal, option of paying you out of her own pocket. Please feel free to consult any legal practitioner ( not your friends or parents who have limited knowledge) and you'll siib realize what i am referring to. I've been privy to your past text exchanges and noticed some of you have the tendency to read what you want to read and disregard other facts, and there are others with the inclination to ask the same questions, phrased differently, over and over again. thus communication was severed understandably.

Continue 11:29am
Now let's address the suggestion which is not accepted.

Continue 11:32am
The primary purpose of clearing a debt is to make it less, and if several people are involved, to make such a group smaller. Following your suggestion , after a month or two, its conceivable that the same number of creditors remain. The offer is still to start from either highest or lowest wage owed. i will need everyone to come in with their preference here, voting by proxy unfortunately can't be verified through texting.

Continue 11:33am
Let's focus on this topic and not bring in our personal problem or thoughts or opinions henceforth. Things will be more efficient this way.

Continue 11:33am
I will come back to this thread tonight.

------ ( chat among our self going on in the chat  )

02 July 2013 8:12pm
Colleague C reply: Start from the one being owed the most first. If you cant decide, then pls pay those with court orders first since there is a legal deadline to it. If no one replies, pls proceed with payment. If xx shop really wants to implement an installment plan, then don't delay anymore. I just wanna get this over and done with. Thank you very much

03 July 2013 10:13am
Middleman reply : I am suspending this discussion since as mentioned, there is a "legal deadline". we will pick this up again once you've exhausted all legal  avenues.
